NOTICE TO:

All owners of real property within the boundaries of OZARK ACRES ROAD AND STREET, RECREATIONAL, FIRE AND AMBULANCE SERVICE, SUBURBAN IMPROVEMENT DISTRICT NO. 1 (the district)

Notice is hereby given that the Board of Commissioners of the District on September 17, 2024 entered an Order of levying an operation and maintenance tax upon real Property in the District to be collected in 2025, to provide funds to pay the cost of operating and maintaining the capital improvements of the district. All persons affected by such Order are warned that the Order shall become final unless suit to contest the Order is brought in the Chancery Court of Sharp County, Arkansas, within thirty (30) days after the first publication of this Notice. The order is as follows:

ORDER LEVYING OPERATION AND MAINTENANCE TAX FOR COLLECTION IN 2025

On the 17th day of September, 2024, at a duly called and held meeting of the Board Of Commissioners of Ozark Acres Road and Street, Recreational, Fire and Ambulance Service, Suburban Improvement District No. l, and the Board of Commissioners, being duly advised, finds:

1. That the assessed benefits to accrue to the real property i11 the District from acceptance, purchase and construction of the improvements and facilities previously undertaken by the District have been duly and properly assessed, equalized, approved and confirmed, and the total assessed benefits to all parcels of real property in the District amount to $3,433,701.23.

2. That in order to provide funds to pay the necessary expenses of operating and maintaining the improvements owned and operated by the District and the expenses of maintaining roads and streets in the District, it is necessary to make provision collection from the assessment of benefits of an annual tax(the operation and maintenance tax) sufficient to pay such expenses in the calendar year next succeeding the calendar year in which the operation and maintenance tax is collected.

IT IS THEREFORE CONSIDERED, ORDERED, AND ADJUSTED:

A. That the assessed benefits in the District shall bear interest at the rate provided bylaw,.and the annual collections on all taxes shall be credited first upon the interest accruing on the assessed benefits.

B. That an annual operation and maintenance tax to be collected in 2025, is hereby levied in the amount of$274,696.10 being the amount necessary, together with other revenues of the District, to pay the reasonable and necessary expenses to be incurred in 2025 in the operation and maintenance of the improvements owned and operated by the District and in the maintenance of roads and streets in tb.e District, and there shall be collected in the year 2025, as the annual operation and maintenance tax

8% of the total assessed benefits of the District, to be paid by the real property in the District on proportion to the amount of the assessments of benefits thereof. The operation and maintenance tax herein levied shall be the only tax of the District to be collected in 2025.

C. That the Board of Commissioners of the District is directed to cause to be extended the tax herein levied on the assessment records of the District for collection in accordance with the law.D. That the tax herein levied shall be carried on the tax books of Sharp County for collection in the year above set forth and shall be collected and applied as above set forth.

E. That an executed copy of this Order shall be filed with the County Clerk of Sharp County to the end that the tax herein levied may be ex:tended by the County Clerk of Sharp County upon the tax books of Sharp County and collected by the

• Collector of Sharp County for collection in.the year aboveset forth..

ADDENDUM:

If any Ozark Acres Suburban Improvement District property owner will show that they have no road frontage to their S.I.D. property, then their tax assessment will be changed, from 8% to the 6%.
