A Cherokee Village man who beat a woman and ran from the home was later captured and arrested. In a surprising turn of events, he was returned to the home later the same day and racked up two additional felony charges: Terroristic Threatening in the First Degree, a Class D Felony, and Intimidating a Witness, a Class B Felony.
John J. Nye, 54, of 60 Poteau Drive in Cherokee Village, was taken into custody after a Dec. 16 call in which Cherokee Police Patrol Officer Roger Wright responded to a domestic disturbance at the home.
A female living in the home with Nye had called the police after he hit her in the face and head after refusing intimate relations. Wright observed blackened eyes, bruising, and multiple contusions on the female. She refused to go to the hospital to be evaluated. Wright observed the female. Running in and out of her home, she projected an image that she did not wish the police to be there to help her. She told officers Nye was not in the home but after explaining his concern for her safety, allowed Wright to search the home. They discovered that the woman’s mother lived with her in the home and had dementia. It was discovered a no contact order was in place against Nye for another physical altercation at Casey’s, in April of last year. The woman and her mother were encouraged to go to a hotel that night in case Nye returned to the home.
The following morning around 8 a.m. the woman again called the Cherokee Village Police Department, advising them that a man, believed to be Nye had returned to the home after she left and took some belongings and called her, telling her he would be at the home in five minutes.
Cherokee Village Patrol Officer Richard Crowe went to the residence to speak with the ladies and provide them with a subpoena to appear in court on Dec. 18. He also noted the swelling and the woman’s injuries in his report.
On Dec. 22, Nye was charged by the Third Judicial District Prosecuting Attorney’s office with Aggravated Assault on a Family Member, a Class D Felony and Violation of a No Contact Order, a Class A Misdemeanor.
About an hour after the woman made the report that Nye was near the home, Officer Crowe made contact with the woman and interviewed her regarding the latest incident. In his Affidavit for Probable Cause, he noted the extreme bruising around her eyes, forehead and sides of her face. She advised the officer that Nye threatened to kill her several times if she did not drop the charges and order of protection. He also requested she give him a cell phone.
The warrant was served on Dec. 22 at the Sharp County Detention Center. Nye had his first appearance on Dec. 29 and bond was set at $40,000 to run concurrently for both offenses.
Court records indicate that Nye has five open felony cases in Sharp County since Nov. 13, 2024 with the remaining four from 2025.
They range from Possession of drugs and drug paraphernalia to two cases of assault on the same family member.
Nye is due in Sharp County Circuit Court on both sets of felony charges on Jan. 26.
